Please read these Terms of Service carefully before using the Gizmoozle online store. By placing an order or using this website, you agree to these terms.

This website is intended for personal, non-commercial use by consumers in South Africa. You agree not to use this website for any unlawful purpose or in any way that could damage, disable, or impair the site.

3. Orders, pricing, and errors

Placing an order on this website constitutes an offer to purchase. We reserve the right to accept or decline any order, and we will notify you promptly if we are unable to fulfil it.

Where a genuine error exists in a product description, price, or availability listing at the time of your order, we will contact you before processing or dispatching the order. You will have the option to proceed at the correct price and description, or to cancel for a full refund. We will not dispatch goods on the basis of a materially incorrect listing without your informed agreement.

Nothing in this section limits your rights under the Consumer Protection Act 68 of 2008 (CPA), including your right to receive goods that match their description and are fit for purpose.

4. Payment

All prices are displayed in South African Rand (ZAR). Payment is required in full at the time of order. Payment is processed through our checkout provider. We do not handle or store your card details directly. Please refer to the checkout payment screen for the payment methods available to you.

5. Delivery

We deliver within South Africa. Delivery methods, timeframes, and costs vary by product and are described on each product page and in our Delivery Information page.

Where a delivery date or timeframe is expressly agreed at the time of purchase, we will make reasonable efforts to meet it. If delivery is delayed beyond any agreed timeframe, you may have the right to cancel and receive a full refund under the Consumer Protection Act 68 of 2008. Where no fixed date is agreed, we will deliver within a reasonable time.

Nothing in this section limits your statutory rights under the CPA or ECTA regarding delivery.

6. Your statutory rights

Nothing in these Terms of Service limits or removes your rights under the Consumer Protection Act 68 of 2008 (CPA) or the Electronic Communications and Transactions Act 25 of 2002 (ECTA). Please see our Returns and Refunds Policy for details of your statutory rights, including the seven-day ECTA cooling-off period and the six-month CPA implied warranty on defective goods. Any term in this agreement that is inconsistent with the CPA or ECTA is void to the extent of that inconsistency.

7. Intellectual property

All content on this website, including text, images, and design, is the property of Gizmoozle or its suppliers and may not be reproduced without permission.

8. Liability

To the extent permitted by South African law, and without limiting any rights you have under the CPA or ECTA, Gizmoozle is not liable for any indirect or consequential loss arising from your use of this website. Your statutory consumer rights are not affected by this clause, and nothing in this section excludes liability for defective goods, unsafe goods, or any other matter for which liability cannot lawfully be excluded or limited under South African law.
